President Martin's campus-wide email neglected to swiftly condemn the order as antithetical to the College’s values. Furthermore, the failure to guarantee concrete material and legal assistance also betrays the College's apathy towards the emotional and physical welfare of the affected members of our community. Amidst the chaos provoked by the order, the International students Office did not reach out to the distressed students. Once again, the international Students Office failed to live up to its stated purpose of "providing international students with immigration and visit advising, programming and support. The Office's repeated inability to meet the pressing needs of the college’s international students stands in direct contradiction with the college's stated mission to educate men and women of exceptional potential from all backgrounds." We have five demands: Within the next 24 hours, the college must publicly condemn the executive order, "Protecting the Nation from Foreign Terrorist Entry into the United States." Peer institutions including Boston University, Yale, Cornell, Harvard and Princeton have already issued clear condemnation of the order, to which President Martin's statement pales in comparison. Within on week, the College must provide concrete legal and material support to those affected, regardless of their specific legal status. This includes: Providing one-on-one legal consultation and representation for students, staff and faculty members who are directly or indirectly impacted by the executive order or whose citizenship status puts them at risk. Committing to provide legal aid for students, staff and faculty members who are, now or in the future, detained or prevented from reentering the US while traveling, included but not limited to emergency contact information for legal counsel. Committing to meet the housing, living and academic needs of students, staff and faculty members who are, now or in the future, unable to leave the United Sates as a result of the executive order 3. Within one month, the college must recognize the shortcomings of the International Student Office meeting its intended purpose. This include: investigating the office’s repeated failure to reach out to international students, especially in times of considerable and relevant policy changes. Hiring additional staff specifically trained and competent in legal matters pertaining to foreign nationals (The College must at least initiate the search within a month) Ensuring that the International Students Office be proactive and responsive to student input. 4. Given the likelihood of increasing uncertainty in the near future, under the current administration, the college must meet its own promise to its students by responding more quickly and proactively to changing policies. 5.The threats posed to members of the Amherst College community are part of a political paradigm shift that is national in scope, and peer colleges and universities have already condemned the action of the current administration and committed themselves to meeting the needs of their community members. Recognize this, the college must join in efforts to build a coalition of institutions that will collectively stand with those members of their communities impacted by these increasingly violent and racist policies. It happened back in the early hours of September 2, but word of the attack is just spreading across campus. Patrick Durocher, 18, of Longmeadow is charged with aggravated rape in the case. He allegedly attacked a female fellow student in the middle of campus, outside the north side of the Campus Center. It was the first weekend of the semester, and according to court documents, the victim was on her way home from a party between 12 and 1 a.m. The victim told police soon after leaving a North Pleasant Street party, she headed towards the Campus Center, where she heard someone ask where she was going. According to a police report, the next thing the victim remembers is allegedly being forced against a tree by Durocher. She says he bit her neck, forced and held her to the ground, and raped her. Nicole Ozer Technology and Civil Liberties Policy Director, ACLU of California Kevin Bankston Policy Director, New America Foundation's Open Technology Institute Timothy Edgar Fellow, Watson Institute for International Studies, Brown University Join ACLU and others for a fun-filled surveillance tour of the movies - from Brazil to Bourne - to talk about what is still fiction and what is now fact. What is technologically possible? What is legal? And what is happening in the courts, Congress, and in companies and communities to reset the balance between government surveillance and individual liberties. Kevin Bankston is the Policy Director of the New America Foundation's Open Technology Institute, where he works in the public interest to promote policy and regulatory reforms to strengthen communities by supporting open communications networks, platforms, and technologies, with a focus on issues of Internet surveillance and censorship. Prior to leading OTI's policy team, Kevin was a Senior Counsel and the Director of the Free Expression Project at the Center for Democracy & Technology. From that position, he spent two years advocating on a wide range of Internet and technology policy issues both international and domestic, most recently organizing a broad coalition of companies and civil society organizations to demand greater transparency around the US government's surveillance practices. Prior to joining CDT, he worked for nearly a decade at the Electronic Frontier Foundation, specializing in free speech and privacy law with a focus on government surveillance, Internet privacy, and location privacy. As a Senior Staff Attorney at EFF, he regularly litigated issues surrounding free expression and electronic surveillance, and was a lead counsel in EFF's lawsuits against the National Security Agency and AT&T, challenging the legality of the NSA warrantless wiretapping program first revealed in 2005. He received his JD at the University of Southern California Law School after receiving his BA at the University of Texas at Austin. Timothy H. Edgar is a visiting fellow at the Institute and adjunct professor of law at the Georgetown University Law Center. His work focuses on the unique policy challenges posed by growing global cyber conflict, particularly in reconciling security interests with fundamental values, including privacy and Internet freedom. Mr. Edgar served under President Obama as the first director of privacy and civil liberties for the White House National Security Staff, focusing on cybersecurity, open government, and data privacy initiatives. From 2006 to 2009, he was the first deputy for civil liberties for the director of national intelligence, reviewing new surveillance authorities, the terrorist watchlist, and other sensitive programs. He has also been counsel for the information sharing environment, which facilitates the secure sharing of terrorism-related information. He has a JD from Harvard Law School, where he served on the Harvard Law Review, and an AB from Dartmouth College. Nicole Ozer developed and has led the technology and civil liberties work for the ACLU in California since 2004. Nicole is a nationally recognized expert on issues at the intersection of consumer privacy and government surveillance and free speech and the Internet. Nicole developed Demand Your dotRights, ACLU's national online privacy campaign and spearheaded the passage of both the first RFID and digital book privacy laws in the nation. Nicole is the author of numerous legal and policy publications, including Losing the Spotlight: A Study of California's Shine the Light Law, Privacy & Free Speech: It's Good for Business, a primer of dozens of case studies and tips for baking safeguards into the business development process. Her most recent law review article, Putting Online Privacy Above the Fold: Building a Social Movement and Creating Corporate Change, was published by the NYU Review Law & Social Change in 2012.
